Terms of Use (EULA)

The legal terms governing your use of Crew.

This End User License Agreement (“Agreement”) is a legal agreement between you (“you” or “User”) and Playriot (“we,” “us,” or “Company”) for the use of the Crew mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by this Agreement.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded products that you own or control, in accordance with the Apple Media Services Terms and Conditions and this Agreement.

2. Age Rating

Use Crew only if you meet the App Store age rating for your country and the legal age of majority where you live. Crew involves coordination around social environments where alcohol may be consumed; you are solely responsible for complying with all applicable laws regarding alcohol consumption, transportation, and personal safety.

3. Subscription — Crew Premium

Crew Premium offers monthly and yearly subscriptions and, where available, a one-time lifetime purchase. The paywall shows the products and local prices Apple makes available. In upcoming Crew 1.0.8, Premium includes the weighted designated-driver wheel and a receipt-photo reader; manual bills, Guardian, history and Crew Wrapped stay free. The current public version is 1.0.7, and the receipt-photo reader and Safety controls are not yet public. Valid Premium can provide shared access to members of the purchaser’s current crews.

4. Auto-Renewal Terms

These renewal terms apply to monthly and yearly subscriptions. The lifetime product is a one-time purchase with no renewal.

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the renewal price disclosed at signup.
  • You can manage your subscription or turn off auto-renewal by going to Settings > Apple ID > Subscriptions on your device, or by tapping Manage Subscription inside the App.
  • You can cancel renewal through Apple. Removing your Crew account does not cancel an Apple subscription. Refund eligibility follows Apple’s terms and applicable consumer rights.

5. Free Trial

If a free trial is offered with Crew Premium, it applies to first-time subscribers only. If you do not cancel at least 24 hours before the trial ends, you will be charged the full subscription price and the subscription will renew at the regular period. Any unused portion of a free trial is forfeited when you purchase a subscription.

6. Refunds

All purchases are processed by Apple via the App Store. Refund requests must be submitted to Apple at reportaproblem.apple.com. We do not process refunds directly.

7. Restoring Purchases

Use Restore purchases on the paywall with the Apple purchase account and Crew account that own the purchase. If you removed and recreated your Crew account, sign in with the same Apple sign-in identity so ownership can be checked. An older receipt without proven ownership may need support; a copied receipt cannot grant access to another person.

8. Acceptable Use

You agree not to:

  • Use the App to harass, stalk, intimidate, or surveil anyone, including members of your own crew. Location sharing is session-bound and consent-based; using shared session data outside that context is a material breach of this Agreement.
  • Upload content (photos, videos, names, drink logs) that you do not have the right to upload, that depicts anyone without their consent in the context shared, or that is unlawful, defamatory, or invasive of another person’s privacy.
  • Misrepresent your identity, age, or relationship to a crew you join.
  • Use the App to violate any law, regulation, or third-party right, including drinking-and-driving laws — the DD Wheel is a coordination aid, not a license to drink and drive.
  • Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
  • Attempt to bypass any security, authentication, or licensing mechanism.

9. Safety Disclaimer

Crew is a coordination tool. It does not provide professional safety services, emergency response, medical advice, transportation, or guarantee that designated drivers will remain sober or that Guardian alerts will be delivered in time. In an emergency, call 911 (or your local emergency number) immediately. You are solely responsible for your own safety, your transportation decisions, and the safety of those you choose to share location with. We are not liable for injury, property damage, missed pickups, undelivered notifications, or any other outcome arising from your use of the App, your crew’s use of the App, or third-party services Crew relies on.

10. User Content

You retain ownership of photos, videos, drink logs, and other content you upload. By uploading content to a session, you grant us a limited, non-exclusive, royalty-free license to store, transmit, review and display it within Crew as described in our Privacy Policy. Photos and videos are pending until owner approval; blocks and reports limit access. Older writable uploads use a private review copy for approved albums and chosen evidence. Shared albums hide media after 30 days, and the existing hourly cleanup retries storage removal. Chosen complaint evidence may remain privately for PLAYRIOT review without an automatic expiry. Removing an upload stops new shared links but cannot revoke downloaded bytes or an unexpired viewing link. Owner review and Safety controls are in upcoming 1.0.8.

11. Intellectual Property

The App, including its source code, design, branding, animations, and content, is owned by Playriot and protected by copyright, trademark, and other intellectual property laws. This Agreement does not transfer any ownership rights to you.

12. Privacy

Use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

13. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYRIOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, MISSED EMERGENCY RESPONSE, UNDELIVERED NOTIFICATIONS, LOST OR LATE LOCATION DATA, OR LOSS OF DATA OR CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice, including for breach of Section 8 (Acceptable Use). Upon termination, your license to use the App ends immediately. Sections 9, 10, 11, 13, 14, and 16 survive termination.

16. Governing Law

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in California.

17. Apple-Specific Terms

You acknowledge that this Agreement is between you and Playriot, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is a third-party beneficiary of this Agreement and may enforce it against you.

18. Changes to These Terms

We may update this Agreement from time to time. The updated version will be posted at this URL with a new effective date. Continued use of the App after changes are posted constitutes your acceptance of the updated terms.
